Hereinafter referred to as “Domaine Grégoire” or “the Seller”.
These General Terms and Conditions of Sale, hereinafter the “Terms”, govern the sale of products offered by Domaine Grégoire to its customers via its website.
Purpose and Scope
These Terms are intended to define the rights and obligations of Domaine Grégoire and its customers in the context of the distance selling of products offered on the site.
They apply to any order placed on the site by a consumer acting for purposes that fall outside their commercial, industrial, craft, professional or agricultural activity.
Placing an order implies full and unreserved acceptance of these Terms. The Customer declares having read these Terms before confirming their order.
Products
The products offered for sale are those presented on the Domaine Grégoire website on the day of consultation by the Customer, subject to available stock.
Domaine Grégoire takes the greatest care in presenting and describing its wines and other products. Photographs, illustrations and representations of the products are provided for guidance only and do not constitute a contractual commitment as to their exact appearance.
In the particular case of wine, variations may occur depending on the vintage, the natural evolution of the product, or changes to packaging, labelling or conditioning.
Product Availability
Product offers are valid subject to available stock. Should a product become unavailable after an order has been confirmed, Domaine Grégoire will inform the Customer as soon as possible.
The Customer may then, depending on the options available, obtain a refund for the unavailable product or accept a replacement product following explicit agreement. No replacement product will be sent without the Customer’s prior consent.
Pre-orders
Certain products may be offered for pre-order before they become effectively available. The projected availability or shipping date given at the time of pre-order is provided as an estimate when it depends on production, bottling, packaging or circumstances beyond Domaine Grégoire’s control.
In the event of a significant delay, the Customer will be informed as soon as possible. The legal provisions relating to delivery and consumer rights remain applicable to pre-orders.
Price
Product prices are shown in euros (€), inclusive of all taxes, at the VAT rate applicable on the day of the order. Any delivery charges are shown separately before final confirmation of the order.
The total price payable by the Customer is displayed before the order is confirmed. Domaine Grégoire reserves the right to change its prices at any time. Products are nonetheless invoiced at the rate applicable at the time the Customer confirms the order.
Orders
The Customer selects the products they wish to purchase and adds them to their basket. Before finally confirming their order, the Customer has the opportunity to check the details of the order, its total price, and to correct any errors.
The order is only definitively registered once the following have taken place: confirmation of the basket; provision of the information required for delivery and billing; acceptance of these Terms; confirmation of the Customer’s legal age when ordering alcoholic beverages; and confirmation of payment.
An order confirmation is sent to the Customer at the email address provided when placing the order.
Domaine Grégoire reserves the right to refuse or cancel an order in the event of fraud or attempted fraud, a payment incident, a prior payment dispute relating to an order, or any other legitimate reason.
Payment
Payment is made using the payment methods offered on the site at the time of the order. The Customer guarantees to Domaine Grégoire that they hold the necessary authorisation to use the chosen payment method.
The order may be considered final once payment has been confirmed. Should payment be declined by the bank or payment service provider, the order may be automatically cancelled.
Transactions carried out through a payment service provider are also subject to that provider’s own operating and security conditions.
Alcohol Sales and Protection of Minors
In accordance with French law, the sale of alcoholic beverages to minors is prohibited. By ordering wine or any other alcoholic beverage on the Domaine Grégoire website, the Customer declares that they are 18 years of age or older on the date of the order.
Domaine Grégoire reserves the right to ask the Customer to provide proof of legal age under the conditions permitted by applicable regulations. In the event of doubt regarding the Customer’s age, or if proof of legal age cannot be established when requested, Domaine Grégoire may refuse to sell alcoholic beverages.
Alcohol abuse is dangerous to your health. Please drink responsibly.
Delivery
Products ordered on the site are delivered exclusively within France, within the areas effectively served and offered at the time of ordering. The Customer is required to provide an accurate and complete delivery address, along with all information necessary for proper delivery.
Delivery charges and the delivery options offered are shown to the Customer before final confirmation of the order. Domaine Grégoire provides the Customer with a delivery date or timeframe based on the information available at the time of the order.
In the event of a delivery delay, the Customer benefits from the rights provided for under the French Consumer Code. Domaine Grégoire cannot be held liable for a delay directly attributable to the Customer, in particular in the event of an incorrect or incomplete address, absence of the recipient, or insufficient delivery information.
Receipt – Damaged Products
Upon receipt of the order, the Customer is advised to check the condition of the parcel and products. If a parcel is visibly damaged, if bottles are broken, or if any other visible anomaly is present, the Customer is invited to note the appropriate reservations with the carrier and to contact Domaine Grégoire as soon as possible at contact@domainegregoire.fr.
To facilitate the handling of the claim, the Customer is invited to provide their order number as well as, where useful, photographs of the parcel and the products concerned. These recommendations do not affect the Customer’s statutory rights and guarantees.
Right of Withdrawal
Where legally entitled to the right of withdrawal, the consumer Customer has a period of fourteen (14) days from receipt of the goods to exercise this right, without having to justify their decision. For orders involving several goods delivered separately, the period runs from receipt of the last item, under the conditions provided for by applicable regulations.
To exercise the right of withdrawal, the Customer must notify Domaine Grégoire of their decision by means of an unambiguous statement or by using the standard form provided at the end of these Terms. The request may be sent to SAS Maurene Grégoire, 1271 Route de la Basse Commune, 44330 Mouzillon, or by email to contact@domainegregoire.fr.
The Customer must then return the products within the legal timeframe following notification of their decision to withdraw. Unless stated otherwise or unless Domaine Grégoire offers to cover them, direct return costs are borne by the Customer.
Products must be returned in a condition allowing them to be resold, without prejudice to the Customer’s right to handle the goods to the extent necessary to establish their nature, characteristics and proper functioning. For safety and preservation reasons, opened bottles in particular cannot be resold. Statutory exceptions to the right of withdrawal remain applicable.
Refunds Following Withdrawal
Where the right of withdrawal is validly exercised, Domaine Grégoire will refund the amounts due in accordance with the provisions of the French Consumer Code, including standard delivery charges where required by law. Any additional costs resulting from the Customer’s choice of a delivery method more expensive than the standard delivery option offered will not be refunded, as provided for by law.
The refund is made using the same payment method used for the original transaction, unless the Customer expressly agrees to a different method, provided this does not incur any charges. Domaine Grégoire may defer the refund under the conditions permitted by applicable law, in particular until the goods are recovered or until the Customer provides proof of their return shipment, whichever occurs first.
Statutory Warranties
Products sold by Domaine Grégoire benefit from the applicable statutory warranties, in particular the statutory warranty of conformity and the warranty against hidden defects, under the conditions provided for by French law. These warranties apply independently of any commercial warranty that may be offered.
A Customer who believes a product to be defective may contact contact@domainegregoire.fr, specifying their order number and the nature of the issue encountered.
Liability
Domaine Grégoire is responsible for the proper performance of its obligations under the conditions provided for by applicable law. However, its liability cannot be engaged where non-performance or improper performance of the contract is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unrelated to the contract, or to a case of force majeure as defined under French law and case law.
Domaine Grégoire cannot be held liable for the inappropriate or excessive consumption of alcoholic beverages sold on its website.
Personal Data
Personal data provided by the Customer is used for the purposes of managing orders, payments, deliveries and customer service, and, where the Customer has consented or where permitted by applicable regulations, for marketing communications.
Personal data is processed in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) and applicable French law.
The Customer may exercise the rights available to them under applicable regulations by contacting contact@domainegregoire.fr. Detailed information regarding data processing, retention periods, recipients and data subject rights is also available in the site’s privacy policy.
Intellectual Property
The texts, photographs, logos, trademarks, illustrations, graphic elements and, more generally, all content present on the Domaine Grégoire website are protected under applicable intellectual property law. Any unauthorised reproduction or use of these elements may constitute an infringement of the rights of their owners.

Consumer Mediation
In accordance with the provisions of the French Consumer Code, the consumer has the right to make free use of a consumer mediator with a view to the amicable resolution of a dispute with Domaine Grégoire, after first submitting a written complaint to the Seller and in the absence of an amicable solution.

Governing Law and Disputes
These Terms are governed by French law. In the event of any difficulty, the Customer is invited to first contact Domaine Grégoire in order to seek an amicable solution.
In the absence of an amicable agreement or resolution through mediation, the dispute may be brought before the competent courts in accordance with applicable legal rules. No provision of these Terms may deprive a consumer of the mandatory protections to which they are entitled.
Amendments to These Terms
Domaine Grégoire reserves the right to amend these General Terms and Conditions of Sale, in particular to reflect changes in its activity or in applicable regulations. The Terms applicable to an order are those accepted by the Customer at the time the order is placed.
